Terms of Service

These Terms of Service (“Terms”) govern your use of the Mendtide iOS app (the “App”) and any related services we provide. By downloading, installing, or using the App, you agree to these Terms.

1. The Service

Mendtide reads sleep, heart-rate, and HRV data from Apple Health on your device and uses it to generate a morning briefing, recovery trends, an in-app coach chat, and a private on-device journal for personal notes. The exact features available may change over time; we may add, modify, or remove features at our discretion.

2. Eligibility

You must be at least 13 years old to use the App. If you are between 13 and the age of majority in your country, you must have your parent or legal guardian's permission. By using the App, you represent and warrant that you meet these requirements.

3. Account

Mendtide uses Sign in with Apple to create your account. You are responsible for the security of the Apple ID you use. You can sign out or delete your account at any time from the App's Settings.

4. Subscriptions and billing

4.1 Subscription plans

Mendtide offers auto-renewable subscriptions:

• Monthly: $9.99 per month
• Annual: $69.99 per year

Both plans include every feature in the App. New users receive a free 14-night trial, after which the selected plan begins billing.

4.2 Auto-renewal terms

Subscriptions are billed through your Apple ID. Subscriptions automatically renew at the selected price unless cancelled at least 24 hours before the end of the current period. Your Apple ID will be charged for renewal within 24 hours of the end of each period. You can manage or cancel your subscription anytime in iOS Settings → Apple ID → Subscriptions.

4.3 Refunds

Apple handles all billing and refund decisions for subscriptions purchased through the App Store. To request a refund, visit reportaproblem.apple.com.

4.4 Price changes

If we change our subscription prices, Apple will notify you before the change takes effect and you will have the option to accept the new price or cancel.

5. Health disclaimer

Mendtide is not medical advice. The App's morning briefings, recovery insights, AI coach responses, and any other content are for general informational and educational purposes only. They are not a substitute for the advice of a qualified healthcare provider.

• The App does not diagnose any sleep disorder or medical condition.
• The App does not prescribe medications, supplements, or doses.
• The App's AI coach is bounded to general sleep-hygiene information; it will not provide medical, psychiatric, or pharmacological advice. It is not a therapist.
• If you have or suspect a sleep disorder (insomnia, sleep apnea, narcolepsy, etc.) or any other medical condition, consult a licensed healthcare provider.
• If you are in a mental-health crisis, contact 988 (in the US) or your local emergency number.
• Never disregard professional medical advice or delay seeking treatment because of something you read or heard from the App.

6. AI coach limitations

The in-app coach uses a large-language-model (LLM) AI to generate responses. AI systems can make mistakes, produce inaccurate information, or misinterpret context. We have built multiple safety layers to keep responses in scope and to refuse medical, prescription, diagnostic, role-play, and crisis-related requests, but no AI system is perfect. Treat AI coach responses as conversational suggestions, not authoritative guidance.

7. Acceptable use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to bypass safety guardrails or extract prompt content
• Reverse-engineer, decompile, or disassemble the App except as permitted by law
• Scrape or programmatically access our backend at a rate that disrupts the service for other users
• Resell or sublicense access to the App

8. Intellectual property

The App, its content, design, and underlying technology are owned by us or our licensors and are protected by copyright, trademark, and other intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

Apple Health data on your device remains yours. Your chat-coach inputs remain yours; you grant us a limited license to process them through our backend solely to generate responses for you.

9. Termination

You may stop using the App at any time. We may suspend or terminate your access to the App if you violate these Terms or if we determine in good faith that continued access is harmful to you, to us, or to other users. On termination, sections that by their nature should survive (disclaimers, liability limits, governing law) will survive.

10. Disclaimer of warranty

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA OR RESULTS. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF LIABILITY FOR CERTAIN DAMAGES; IN THOSE JURISDICTIONS, THE ABOVE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED.

12. Indemnification

You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the App.

13. Changes to these Terms

We may update these Terms when the App's features, pricing, or legal obligations change. The “Last updated” date at the top reflects the most recent revision. Substantive changes will be surfaced in the App on next launch. Your continued use of the App after a revision means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles. Any dispute will be brought in the state or federal courts located in Ellis County, Texas, and you consent to that jurisdiction and venue.

15. Apple-specific terms

These Terms are between you and us; Apple is not a party. Apple has no obligation to provide any maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them.
